It's ok if you're scared off by this, I never meant to be your friend anyways.
Now
here's a rude comment bordering on cruelty. I personally would dismiss a mod who talks back like this and who, allegedly, has made at least one member leave by his/her actions.
1. Respect the other users, the moderators and the administrators. Personal offences are not tolerated. Also, don’t go out of your way to find something to be offended over. If you think you are being harassed or stalked by another member in any way, contact one of the administrators. Could the forum management please ensure that the rules constructed be obeyed? Mature behaviour in a mod wouldn't hurt, you know.
By the way, have you ever heard of "fair use"? I'm referring to this rule:
Pictures that are under copyright are allowed to be posted on the forum, as long as they add this to their post: „This/these images are posted under the fair rights agreement. Copyright belongs to the respective owners.“ This includes scans of magazines and photo books not available from official stores any more (they are only available from second-hand stores/auction sites/etc). This rule doesn't apply to signatures and avatars. Fair use doctrine states that:
Notwithstanding the provisions of sections and , the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
the nature of the copyrighted work;
the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.[1]So, what counts as a copyright infringement is to deliberately gain profit by the copying, by repeating too much a portion of it "as is", and also by
not putting its context in a new light. Please read more at
http://en.wikipedia.org/wiki/Fair_useSo, I believe that if I, for example, scan a Yoshiki picture off a magazine and then make a parody of it or construct an argument around it,
I certainly am not infringing any copyright. But I would infringe the copyright if (1.) I collected all or most of the pictures the studio took that day, (2.) displayed them or any one of them without any novelty of context, i.e., if I did not use them for a creative purpose, or (3.) if I tried to gain monetary profit from them.
Here's a video I encourage ALL the parties to watch:
